ஒப்பந்த ஊழியர்களின் பிரச்சனையை அங்கீகரிக்கப்பட்ட சங்கத்தோடு பேசக்கூடாதாம்(!)

ஒப்பந்த ஊழியர்களின் பிரச்சனையை, அங்கீகரிக்கப்பட்ட சங்கத்துடன் கூட விவாதிக்கக் கூடாது என தலைமை பொது மேலாளர்களுக்கு வழிகாட்டி 21.10.2016 அன்று கார்ப்பரேட் அலுவலகம் ஒரு கடிதத்தை எழுதியுள்ளது. BSNL ஊழியர் சங்கம் இதனை வன்மையாக கண்டித்ததோடு, இந்தக் கடிதத்தை திரும்பப் பெற வேண்டுமென CMD BSNLஐ வலியுறுத்தி உள்ளது. தமிழக தலைமை பொது மேலாளர் அலுவலகம் உள்ளிட்ட 90 சதவிகித இடங்களில் குறைந்த பட்ச கூலி, EPF, ESI உள்ளிட்டவைகளை அமுலாக்க வேண்டும் என்கிற கார்ப்பரேட் அலுவலகத்தின் உத்தரவுகள் அமுலாக்கப்படுவதில்லை. இந்த இடங்களில் எல்லாம் ஒப்பந்த ஊழியர்கள் கடுமையாக சுரண்டப்படுவதோடு, அவர்களுக்கு சேர வேண்டிய பணத்தை, ஒப்பந்ததாரர்களும், ஊழலில் திளைக்கும் சில அதிகாரிகளும் கொள்ளையடிக்கின்றனர். இதைப்பற்றி எல்லாம் ஒப்பந்த ஊழியர்கள் கேள்வி கேட்டார்கள் என்றால் அவர்கள் பணியில் இருந்து தூக்கி எறியப்படுகின்றனர். சங்கம் அமைக்க முயற்சித்தாலும் அவர்களின் கதி அதோகதி தான். ஒப்பந்த ஊழியர்களின் சட்ட பூர்வ உரிமைகளை அமுலாக்க வேண்டும் என கார்ப்பரேட் அலுவலகம் ஒரே மாதிரியான கடிதங்களை எழுதி வருகிறது. ஆனால் தலமட்டங்களில் அவற்றை முறையாக அமுலாக்குவதை உறுதி செய்ய உருப்படியான நடவடிக்கை இல்லை. ஒப்பந்த ஊழியர்களை சுரண்டுவது தொடரும் வரை அவர்களின் உரிமைகளுக்கான போராட்டத்தில் BSNL ஊழியர் சங்கம் என்றும் முன்னணியில் இருக்கும். இது போன்ற கடிதங்களை எழுதுவதை கைவிட்டு பிரச்சனைகளை தீர்வு காண நிர்வாகம் தயாராகட்டும்.

ஊழியர்களின் தேங்கியிருக்கும் பிரச்சனைகள்

ஊழியர்களின் தேங்கியிருக்கும் பிரச்சனைகளுக்காக 08.09.2016 அன்று நாடு தழுவிய தர்னா போராட்டங்களும், 20.09.2016 அன்று உண்ணாவிரத போராட்டங்களும் நடைபெற்றது. இந்த போராட்டத்திற்கான கொடுத்த அறிவிப்பின் அடிப்படையில் REGIONAL LABOUR COMMISSIONER(CENTRAL) பேச்சு வார்த்தையை துவங்கினார். ஒரு சில கூட்டங்கள் நடைபெற்றுள்ளது. 24.10.2016 அன்று ஒரு கூட்டம் நடைபெற்றது. இதற்கான ஒரு குறிப்பை தொழிலாளர் நல ஆணையருக்கு நமது மத்திய சங்கம் கொடுத்திருந்தது. RLC(C) ஆக புதிதாக பொறுப்பேற்றுள்ள திரு தேஜ் பகதூர் இந்தக் கூட்டத்தை நடத்தினார். நிர்வாகம் கொடுத்த கூடுதல் குறிப்பின் மீதான நமது சங்கத்தின் பதிலை வழங்க கேட்டுக் கொண்ட RLC(C) 22.11.2016 அன்று அடுத்த கூட்டத்தை கூட்டுவதாக தெரிவித்துள்ளார்.

இந்த மாத ஊதியத்துடன் PLI
BSNL ஊழியர் சங்கம் தீபாவளி பண்டிகைக்கு முன் 2014-15ஆம் ஆண்டிற்கான PLIஐ வழங்க வேண்டும் என வலியுறுத்தி வருகின்றது. இது தொடர்பாக நமது மத்திய சங்கம் கார்ப்பரேட் அலுவலகத்தில் உள்ள GM(T&BFCI)யுடன் விவாதித்த போது இந்த மாத ஊதியத்துடன் PLI வழங்கப்படும் என தெரிவித்துள்ளார். 29ஆம் தேதி சனிக்கிழமை கார்ப்பரேட் அலுவலகத்திற்கு விடுமுறை என்பதால் 27 அல்லது 28ஆம் தேதிகளில் ஊதியம் மற்றும் PLI பட்டுவாடா நடைபெறும்

ஊழியர்கள் 300 நாட்களுக்கு மேல் விடுப்பை சேர்த்துவைத்துக் கொள்ளலாம்:-

பஞ்சாப் மற்றும் ஹரியானா உயர் நீதி மன்றம் ஒரு ஊழியர் அதிகபட்சமாக 300 நாட்கள் விடுப்பை காசாக்கிக் கொள்ளலாம் என்று இருந்தாலும், ஒரு ஊழியர் எடுக்காமல் வைத்திருக்கும் விடுப்பை 300 நாட்களுக்கு குறைக்கக் கூடாது என ஒரு சிறப்பான தீர்ப்பை சொல்லி உள்ளது. ” ஒரு ஊழியர் அதிகபட்சமாக 300 நாட்கள் விடுப்பை மட்டுமே காசாக்கிக் கொள்ளலாம் என இருந்தாலும், அதிகபட்ச வரம்பாக அவர் பயன்படுத்தாத விடுப்பை 300 நாட்கள் மட்டுமே என குறைக்கக் கூடாது என்பது அதன் பொருள் அல்ல. ஒரு ஊழியர் ஓய்வு பெறும் வரை அவரது விடுப்பு சேர்த்துக் கொள்ளலாம்; மனுதாரர் சட்டத்தில் உள்ளது போல அதிகபட்சமாக 300 நாட்கள் விடுப்பை காசாக்கிக் கொள்ளலாம்” என்று அந்த தீர்ப்பில் கூறப்பட்டுள்ளது

4.10.2016]Decisions of the meeting of the Core Committee of the Forum of BSNL Unions and Associations.

A meeting of the Core Committee of the Forum of BSNL Unions and Associations was held today the 14.10.2016, in Room No.706 of BSNL Corporate Office. Com. Prahlad Rai, GS, AIBSNLEA, presided over the meeting. The following decisions were taken unanimously:- 

(1)   It is learnt that the government is moving fast in the direction of forming BSNL’s Subsidiary Tower Company, which will be detrimental to the future of BSNL. Hence, the meeting decided to conduct demonstrations on 26.10.2016, at the Corporate Office, circle and district levels, opposing formation of the Subsidiary Tower Company. The future course of action on this issue will be decided in the next meeting of the Forum, to be held on 17.11.2016. 

(2)   As regards improving the financial viability of BSNL, the meeting appreciated the Management and the entire employees, since BSNL continues to give the highest number of mobile connections every month. The meeting noted with satisfaction that BSNL has given 23 lakh mobile connections in September, 2016. The meeting called upon the Non-Executives and Executives to take all out efforts to further increase the sales and revenue of the Company, since this year’s financial results will be very crucial for the forthcoming Wage Revision. The meeting also urged upon the employees to take best efforts to provide good quality services to the customers, by maintaining the networks fault-free. As regards chalking out action programme to face the challenges thrown by the entry of Reliance Jio, it is decided to hold a full-fledged meeting of the Forum on 17.11.2016, and to discuss the issue.

(3)   ‘Telecom Live’, a monthly journal on Telecom Sector, is continuously printing articles and materials, maligning BSNL and tarnishing it’s image, at the behest of ‘vested interests’. Hence, today’s meeting decided to conduct a lunch hour demonstration at BSNL Corporate Office on 17.11.2016, condemning Telecom Live. It is also decided in the meeting, to write a complaint to the Press Council of India, against Telecom Live. 

(4)   BSNL Management and the employees are taking great efforts for reviving the Company. These efforts have started yielding good results. However, the meeting observed with regret that, the DoT, which is expected to support BSNL, is actually taking decisions against BSNL. Hence, it is decided in the meeting, to write a detailed letter to shri Manoj Sinha, Hon’ble Minister of State for Communications, explaining the efforts being taken by the BSNL Management and it’s employees for the revival of the Company, as well as about the decisions and actions of the DoT, against BSNL.

[14.10.2016]Declare JTO LICE results without delay and hold the next JTO LICE as per schedule - BSNLEU demands. 

Com. P.Abhimanyu, GS, met Ms. Anima Roy, GM(Rectt.&Tng.) and demanded expeditious declaration of the results of the JTO LICE held on 24-09-2016. The GM(Rectt.&Tng.) stated that the declaration of the results is getting slightly delayed, since BSNL has started following the standard procedure being followed by other PSUs, for online exams, with regards to declaration of results. According to this, after ascertaining the views of the candidates, with regards to wrong questions etc., the Experts Committee will take decisions and based on that, results will be declared. In any case, the GM(Rectt.&Tng.) assured that the results would be declared by around 27^th October.  The GS demanded that there should not be any postponement of the JTO LICE to be held on 11-12-2016, for which he was assured that the JTO LICE would be held as per the schedule.

[14.10.2016]CMD BSNL urged to constitute the Wage Negotiation Committee for the Non-Executives, without further delay.

In today's meeting with the CMD BSNL, com. P. Abhimanyu, GS, explained in detail, the need to expeditiously form the Wage Negotiation Committee for the Non-Executives. The GS convincingly told the CMD BSNL, that if formation of the Wage Negotiation Committee is delayed, it will result in an undesirable situation, wherein the wage settlement of the Non-Executives will be greatly delayed, even after the wage settlement of the Executives. The CMD BSNL agreed with the GS, and assured that the matter would be positively looked into.
